Terms of Service

I. Defining Terms

The terms that are capitalized will have the meanings listed below, unless otherwise indicated:
Account refers to and encompasses the User's account created on the Site in compliance with the provisions of the Agreement, registered with Hyracorp, and approved by the latter.
Terms & Conditions, Privacy Policy, and any other terms and conditions that may be mutually agreed upon by Hyracorp and the User with regard to the Services are collectively referred to as the "Agreement."
All statutes, rules, regulations, subordinate legislation, ordinances, judgments, rules of law, orders (interim or final), writs, decrees, clearances, authorizations, directives, circular guidelines, policies, requirements, code of practice, guidance notes, and other governmental, regulatory, statutory, administrative restrictions, or determinations by, or interpretations or administrations of any of the aforementioned by, any statutory or regulatory authority or government agency or any other authority, in each case having jurisdiction over the subject matter of this Agreement, are all considered applicable laws.
The term "broker" refers to any broker, channel partner, sales agency, or other third party that negotiates or acts on behalf of one person in a transfer transaction, such as a sale, purchase, leave and license, lease, or other type of transfer pertaining to a plot, apartment, or building, as the case may be. It also includes a person who introduces potential parties to each other for negotiations through any medium, and it includes property dealers, brokers, middlemen—whatever their name may be—and real estate agents as defined by the Real Estate (Regulation and Development) Act, 2016.
Computer viruses are defined as any computer program, information, data, or instruction that, when executed or when another event occurs in that computer resource, destroys, damages, degrades, or adversely affects the performance of that computer resource. They can also attach themselves to other computer resources and function there.
Confidential Information means and includes all information that is not in the public domain, in spoken, printed, electronic or any other form or medium, relating directly or indirectly to, the assets, business processes, practices, methods, policies, subscription plans, publications, documents, research, operations, services, strategies, techniques, agreements, contracts, terms of agreements, transactions, potential transactions, negotiations, pending negotiations, know-how, trade secrets, computer programs, computer software, applications, operating systems, software design, web design, work-in-process, databases, manuals, records and reports, articles, systems, material, sources of material, supplier identity and information, vendor identity and information, User identity and information, financial information, results, accounting information, accounting records, legal information, marketing information, advertising information, pricing information, credit information, developments, internal controls, security procedures, graphics, drawings, sketches, sales information, costs, formulae, product plans, concepts, ideas, creations, unique works of authorship, discoveries, and specifications of Hyracorp, affiliates, or their respective businesses; any current or potential client, supplier, investor, or other related third party; or any other individual or organization that has entrusted Hyracorp with confidential information.

Anything and everything on the site that is not explicitly stated otherwise is considered content.
Any government, state, or other political subdivision thereof; any body performing executive, legislative, judicial, regulatory, or administrative functions of or pertaining to government; any other government authority; any court, tribunal, or arbitrator(s) of competent jurisdiction; and any government or non-government self-regulatory organization, agency, or authority; having jurisdiction over the Agreement and the Services contemplated under the Agreement. Any and all of the foregoing are considered to be examples of government authority.

Act refers to the Information Technology Act of 2000.
The term "intellectual property" refers to and encompasses the following: patents, inventions, know-how, trade secrets, trademarks, service marks, designs, tools, devices, models, procedures, processes, systems, principles, algorithms, works of authorship, flowcharts, drawings, and other proprietary and confidential information; data, documents, instruction manuals, records, memoranda, notes, user guides; ideas, concepts, information, materials, discoveries, developments, and other copyrightable works; and techniques in either printed or machine-readable form, whether or not patentable; and each of these items would by definition be considered public domain.
The term "intellectual property rights" refers to and encompasses the following: (a) all rights, titles, and interests under the Patents Act, 1970, Trademarks Act, 1999, and Copyright Act, 1957, respectively; any statute or under common law including patent rights; copyrights including moral rights; and any similar rights in respect of Intellectual Property, anywhere in the world, whether negotiable or not; (b) any licenses, permissions, and grants in connection therewith; (c) applications for any of the aforementioned and the right to apply for them in any part of the world; (d) the right to obtain and hold appropriate registrations in intellectual property; and (e) all extensions and renewals thereof; (f) any causes of action connected thereto, whether past, present, or future; (g) any Confidential Information; (f) the rights to profits and damages, due or accrued, arising out of past, present, or future infringements or violations thereof; and the right to sue for and collect the same.
Hyracorp refers to and comprises Hyracorp Property Management Private Limited, a business that was established in accordance with the Companies Act of 2013 and has its registered office in Kerala, India. It also includes its officials, directors, workers, and representatives.
The term "Prohibited Conduct" refers to the following: using the Service in a way that violates the Agreement and Applicable Law; violating or aiding in the violation of third party rights; violating or misappropriating Hyracorp's or any other person's intellectual property rights; attempting to obtain or helping another person/user obtain unauthorized access to the Site and/or Services or its related systems or networks; creating links to the Site or "framing" or "mirroring" any content on any other server or wireless or Internet-based device; sending spam, duplicated, or unsolicited messages; using or storing derogatory, threatening, or otherwise illegal or tortious material, including material that is harmful to minors or infringing the privacy rights of third parties or annoyance to any individual; alter or create derivative works based on the Service and/or impersonate someone else or an organization; unauthorized access to another person's account; inaccurate representation of user information; and/or fraudulent affiliation claims.
Registration data is defined as the username, email address, mobile number, and any other details that the user provides on their initial registration and subscription and that Hyracorp may require.
Information about an individual's Aadhaar card, PAN card, biometrics, bank account, debit card, credit card, and other sensitive data that can be used to personally identify the user or concerned party is referred to as personal information.
Services refers to the services that Hyracorp offers users of the site within the borders of India. These services include (a) facilitating the connection between tenants and owners so that they can locate one another without having to pay a brokerage fee, (b) services to users who want to list their properties for rental purposes; (c) services to users who want to purchase or acquire a property through the site; and (d) services to users regarding paperwork and processing of paperwork, including registration of lease agreements, bank franking, police verification, and society approvals with reference to the rental property listed on its website. (e) services to people looking to buy web space for their goods or services to be advertised, (f) services for Users desiring to receive promotional emails and texts as well as advertisements on the Site; (g) a building-specific network for residents to interact with neighbors and exchange neighborhood knowledge; (h) services for Users enabling them to use third-party payment gateways on the Site to send rental money to other Users; (i) connecting Users to various Third Party Service Providers for the provision of other related services.
The term "site" refers to and encompasses the mobile application that is owned, maintained, and managed by Hyracorp Property Management Private Limited as well as the website that is owned, operated, and managed by Hyracorp Property Management Private Limited at the URLs www.Hyracorp.in (www.Hyracorp.com)
Terms and Conditions refers to and encompasses the provisions and clauses found in the Agreement.
Any service provider with whom Hyracorp has a service arrangement for the purpose of providing services to the User in addition to the Services is referred to as a Third Party Service Provider.
The term refers to any individual who uses the site or its services in order to host, publish, share, transact, display, or upload data or views. This includes both tenants and owners who are looking for new tenants as well as other users who use the site together.
Information about Users that the User provides to Hyracorp about the Services, whether via the Site, email, or any other mutually agreeable communication channel, is referred to as User Information. This includes Registration Data, Personal Information, and any other data, details, or information about the User.

II. Definition

A reference to any legislation or law shall include any such legislation or law as it may from time to time be amended, supplemented, or re-enacted, and any reference to a statutory provision shall include any subordinate legislation made from time to time under that provision, unless the context requires otherwise or there is a clear indication to the contrary.
In this Agreement, "person" refers to any individual, corporation, partnership, unincorporated organization, or governmental agency, as well as their respective successors and permitted assigns. If an individual, "person" also refers to his or her legal representatives, administrators, executors, and heirs; if a trust, "person" refers to the trustee or trustees as of right now.
Headings to Sections and Clauses are merely included for convenience and are to be disregarded when constructing the pertinent Sections and Clauses.
Terms that import one gender include all genders, and the singular includes the plural and vice versa.
'Other', 'otherwise', and 'whatsoever' shall not be interpreted shall they be interpreted as restricting the scope of any earlier terms or matters expressly mentioned.

III. Agreement With The Terms And Conditions

The Terms and Conditions and Privacy Policy accepted by the User constitute the Agreement between the User and Hyracorp, which will be deemed to supersede any prior agreements between the User and Hyracorp regarding the Services and Site access. Hyracorp agrees to provide the User with the Services, and the User agrees to use the Services from Hyracorp in accordance with and on the basis of this Agreement.
By completing the registration process and accessing the Site, the User agrees to be bound by the Agreement each time.
The User certifies to Hyracorp that they are eighteen (18) years of age or older, capable of entering into, carrying out, and abiding by the terms of the Agreement. Under no circumstances may anyone under the age of eighteen (18) access the Site or use any of the Services without the involvement, supervision, direction, and/or prior approval of their parents or legal guardians, either through their Account or under their direct supervision. It shall not be Hyracorp's responsibility to confirm that the User is at least eighteen (18) years old.

IV. Getting Access To The Website

New users don't need to create an account in order to access the site and browse around for now.
In order to obtain certain information and make use of the Services, the User shall supply User Information, upload Content, and establish an Account.
Hyracorp will ask the user for their one-time password in order to validate the account. A mobile number may only be used once to register an account, the user acknowledges and accepts. Multiple Account creation is forbidden by Hyracorp, which maintains the right to carry out the necessary verification in order to identify and address any instances of multiple Account creation.

V. Plans for Subscriptions

Subject to the User's needs and upon payment of applicable fees, Hyracorp offers a mix of Services to which the User may subscribe.
Absent the User's selection of the Money back Plan as specified on the Site, the subscription cost paid by the User is non-refundable.
At any point before, during, or after the User subscribes to the plan, Hyracorp retains the right to modify the cost of any subscription plan without providing notification to the User. The User agrees to pay Hyracorp the difference in the amount after the revision, and Hyracorp will notify the User of the new fees.

VI. User Information

Hyracorp disclaims all obligation with regard to the User Information, including its correctness, quality, integrity, legality, dependability, appropriateness, and intellectual property rights.
In the event that any User Information is lost, destroyed, altered, altered, or fails to be stored, Hyracorp disclaims all liability.
Hyracorp retains the right, at its sole discretion, to deny access to, remove, or discard any User Information, in whole or in part, from the Site.
Hyracorp will have the ability, but not the duty, to keep track of or forward any User Information and to confirm the veracity of any User Information provided to it via the Site or in any other way.

VII. The rights of Hyracorp

Hyracorp retains the right, at any time, to reject or disable an account in the event that the user violates any applicable laws, violates this agreement, or for any other reason pertaining to the safe and secure operation of the site.
Hyracorp has the internal infrastructure in place to verify the Account and User Information and do a background check, according to Applicable Law, to make sure that the Brokers are not enrolling themselves on the Site. If a User is found to be a Broker, Hyracorp reserves the right to refuse or deactivate that User's account without explanation.
At any time, without giving the user any prior notice, Hyracorp retains the right to alter, suspend, or terminate all or any portion of the Services, including its features, fees, structure, and layout. It also has the right to temporarily or permanently suspend or deactivate the user account and/or the user's access to the Site.
When Hyracorp needs to repair something, inspect something, or test something for a government agency, or for any other reason Hyracorp sees fit, Hyracorp will try to give the user advance notice, though it is not required to do so. In order to correct any disruption or error on the Site and resume normal operations, Hyracorp will make every effort to the site.
Hyracorp may send the User information about promotions or other pertinent details about the Services, as well as notices, confirmations, and other communications via email, text message, or any other form that the User may agree upon on the Site. Unless users have specifically requested not to receive these emails, Hyracorp may also occasionally send users email newsletters. These emails might also include advice and recommendations, area information, or any other offers from outside parties. Regarding the legitimacy of any of these offers, Hyracorp disclaims any liability. The users will always be able to unsubscribe from receiving these notifications and advertising materials by emailing ifo@hyracorp.com.

VIII. Access Without Permit

The User will bear responsibility for all actions taken through the User's Account and will need to maintain the Account's password and data secure.
Subject to Applicable Law, the User shall report Hyracorp right away in the event that any misuse of the Account or unauthorized access results in a security breach in accordance with Hyracorp's Terms and Conditions and Privacy Policy.
In addition to taking any other essential safety precautions, Hyracorp will provide support by guaranteeing the prompt termination or suspension of the account. Hyracorp further agrees that it will not be responsible for any illegal access to the Account, loss or damage that results from such access to the User, or loss or damage that results from the User's failure to notify Hyracorp of such illegal access on time.
It is advised that the User periodically changes the Account's password to further enhance the confidentiality of the User Information.

IX. Information Use

Hyracorp agrees to follow the Information Technology Act 2000, its rules, and other pertinent Applicable Laws at all times when acquiring, storing, using, and disseminating any information, including User Information and/or Content, as applicable, in accordance with this Agreement. This includes when the Services expire or when the User and Hyracorp terminate their agreement.
By signing this agreement, the user gives Hyracorp full permission to use their information for the uses listed below, among other uses.
- Deliver services in line with the terms of the agreement;
- Reveal user information to its directors, officers, staff, advisers, auditors, lawyers, or its authorized representatives as necessary to carry out the services;
- Get in touch with a third party service provider and/or facilitate/enable the services of a third party service provider for the user in accordance with the agreement between Hyracorp and such third party service provider;
- Carrying out internal research, surveying customers, conducting consumer research, and creating reports related to the Services;
- Filling out an account registration form, receiving alerts, getting in touch with a buyer or seller of real estate; and
- Sending out alerts, contact information, promotional messages, and promotional calls, either directly from Hyracorp or via its partners, vendors, and sub-partners.
- Giving personally identifying information to outside parties (such as law enforcement or the User's building management staff) when Hyracorp has a good faith belief that the Users have engaged in any Prohibited Conduct.
External services
- Hyracorp will occasionally use Third-Party Service Providers' services, either directly or indirectly, in order to provide the Services to Users, subject to the need and request of the Users, and in compliance with the terms and conditions that have been separately agreed upon by Hyracorp and such Third-Party Service Provider.
- In order to offer the User a one-stop shop experience for ancillary services, such as packing and moving furniture, neighborhood information, or doorstep registration facilities, Hyracorp may suggest the services of a Third-Party Service Provider.
- In order to share User Information with a Third-Party Service Provider, either in whole or in part, without prior notice to the User, Hyracorp must get the express agreement of the User.
- Applicable and eager Third Party Service Providers may use the Site as a platform to advertise or promote their services in connection with Hyracorp's services.
- Nothing in this document may be construed as creating or representing an agency, partnership, or group of people acting on behalf of Hyracorp or any Third-Party Service Provider. This clause's arrangement is rigorously carried out on a principal-to-principal basis, and each party involved is responsible for fulfilling their own obligations, rights, and liabilities in line with the applicable bilateral agreement between those parties.
Customized Promotion
- By using this website, the user agrees and acknowledges that Third Party Service Providers may use cookies or other similar technologies to gather information about how the user uses the services. This information is then used to inform, optimize, and provide advertisements based on the user's visits to the site and overall browsing patterns. Additionally, the user agrees to report on how the user interacts with Third Party Service Providers' advertisements and other uses of their services, as well as how these impressions and services relate to the user's visits to the third party's website.
- In order for Third Party Service Providers to access the Site and use the Services, Hyracorp also gives them permission to place customized adverts on the User's device and to use their own cookies or comparable technologies.
- Users should be aware that Hyracorp makes no guarantees regarding the quality, integrity, or accuracy of any content that is supplied by Third-Party Service Providers. In addition, any interactions that Users may have with Third-Party Service Providers that they may find on or through Hyracorp's services on the Site, including the payment and delivery of goods and services as well as any other terms, conditions, warranties, or representations related to those dealings, are strictly between Users and the Service Providers. Hyracorp will never be responsible for any losses that result from communications between the user and such a third-party service provider. Users are given with the information on the Site "AS IS, WHERE IS".
Platform Of Hyracorp
- The Users understand and accept that Hyracorp is merely an online platform that facilitates User-to-User communication for the purpose of listing Property on the Site and/or looking for suitable choices. The Users further comprehend and agree to the following:
- Hyracorp is merely a facilitator and is not accountable or liable for the Users' choice of other Users with whom to interact on the Site, or for any other actions taken by the Users in this regard.
- Based on the data that the Users give Hyracorp, Hyracorp may give the Users profile previews of other Users who would be qualified to tender for the needs of the Users. Please be aware that Hyracorp (i) does not support or suggest any other User, including any landlords or tenants who have registered on the site; and (ii) makes no warranties or claims whatsoever regarding other Users or the properties they have posted. For any reason, Hyracorp will not be held responsible for disagreements that arise between Users, nor will Hyracorp be held accountable for any negative outcomes that Users may experience when interacting with other Users on the Site.
- All information on Users and/or third parties whose services Users use through the Site is provided only for general reference and is published on the Site. Users and/or third parties self-report the majority of this information, which is subject to periodic revision, omission, or inaccuracy. Regarding other Users or the property they have listed, Users are urged to independently confirm any such information they come across on the Site.
- In particular, but not limited to, service-related issues, issues pertaining to Prohibited Conduct, and fraudulent activity, are strictly between the Users and/or the third party, and the Users understand and agree that Hyracorp shall not be responsible for any such interactions and associated issues. Users may also interact with other Users and/or third parties through the Site, or through third parties whose services the Users avail through the Site. The Users assume all risk if they want to interact with other Users.
- The capacity or intention of Users to fulfill their responsibilities under any transaction is not guaranteed by Hyracorp, and Hyracorp cannot guarantee that any transaction will be completed. Before choosing a user and/or communicating with other users on the Site, Hyracorp urges Users to conduct their own research.

X. Terms And Conditions For Hyracorp Payment

Role: Rent payments, maintenance payments, and security deposit/token amounts may be made by any registered user of the site through the payment gateway(s) that Hyracorp has allowed. Users are requested to furnish standard billing details in this regard, including their name, financial instrument details (such as their bank account number and IFSC code), the identity of the landlord to whom the payment is due, and the address of the property for which the rent or security deposit is due. Users could also be required to submit a copy of the lease that governs the terms under which these rent payments are being made. It is the responsibility of the Users to ensure that the information they submit on the Site is correct, complete, and up to date at all times, especially when making payments through the Site. Users submit all information, including payment information, and Hyracorp shall not be liable for any loss incurred by Users as a result of inaccurate information. Users are solely responsible for the accuracy and completeness of the information they provide. With the exception of its restricted function in handling payments that registered Users authorize or start, Hyracorp has no involvement in any underlying transaction involving the User, other Users, third parties, or service providers. Hyracorp is not a bank and does not provide any services related to banking. Hyracorp may outsource the provision of the Service and handling of User transactions to one or more third parties (each referred to as a "Processor"). Hyracorp particularly disclaims any duty for any conduct or omission on the part of any User or Processor and does not guarantee payment on behalf of any registered User, other User, or Processor. Hyracorp does not act as an agent for any registered User, lessee, or lessor. The only role Hyracorp plays in facilitating payments is that of an intermediary between the intended third-party recipients and the registered Users making the payment.
Permission: The User agrees that Hyracorp has permission to retain, accept, and distribute funds in compliance with the User's payment instructions supplied via the Site in order to facilitate the transfer of funds to the designated beneficiary as indicated by the User on the Site. [The consent granted by the Users enables Hyracorp to: (a) debit or credit the User's bank account, balance, credit card, debit card, or other payment card, or any other method of payment that Hyracorp accepts; or (b) process payment transactions that the Users authorize by executing an electronic funds transfer.
Fees: The User acknowledges that by utilizing the Site to pay for rent or security deposits, Hyracorp may charge them a service charge.
Transaction Limits: Hyracorp reserves the right to refuse, suspend, or delay a transaction for any payment for any reason, including but not limited to if Hyracorp believes the transaction could put it at risk financially or security-wise or if it is unauthorized, fraudulent, suspicious, illegal, in violation of this Agreement's terms, up for dispute, or otherwise unusual.
Chargebacks: If a transaction is (a) disputed by the sender, (b) reversed for any reason, (c) not authorized or Hyracorp has reason to believe that it was not authorized, or (d) purportedly unlawful, suspicious, or in violation of this Agreement, the amount of the transaction may be charged back or reversed to the User (a "Chargeback"). The amount of any Chargeback and any related fees, fines, or penalties assessed by Hyracorp's Processor, processing financial institutions, MasterCard, Visa, American Express, Discover, and other payment card networks, associations, or companies ("Networks") are due and payable by the Users to Hyracorp immediately. Users consent to help Hyracorp look into any of their transactions handled through the Service upon request, at their own expense. When it comes to chargebacks related to cards, Hyracorp will assist users in disputing the chargeback with the Network or the issuing banks, should they so desire. In order to contest the Chargeback, Hyracorp will, in this regard, require certain information from the User. If the User fails to provide the required documentation within 5 business days of Hyracorp's request, among other things, to help Hyracorp promptly in its investigation of a transaction, there may be an irreversible Chargeback.
Liability: The Users grant Hyracorp release from any liability for any matter resulting from a disagreement between the Users and the Processor, or between the Users and their bank or other financial institution. Please be aware that Hyracorp disclaims all duty in this regard and that it shall not be liable for any additional fees or charges that the Processors deduct while processing payments in connection with the User's transaction. In addition, before authorizing any payments through the Processors, Users should review any additional terms and conditions that may be imposed by these Processors.
Fraud and restrictions: If Hyracorp determines that it needs more documentation (such as a rental agreement, owner/tenant PAN, or maintenance bill), it may do so, especially if the transaction appears suspect. In the event that Hyracorp decides that a payment is fraudulent or that it is not a legal rent, token, security deposit, or maintenance payment, Hyracorp will return the full amount (less the nominal processing fees that Hyracorp has collected) unconditionally. A legally binding rental agreement between the landlord and the tenant, for which the rent amount is equal to what is being sent on Hyracorp Pay, is a prerequisite for a valid rent or security deposit payment. A maintenance bill between the payer and the society/RWA is required for a maintenance payment to be considered genuine.
Refunds: If Hyracorp encounters any technical issues and is unable to arrange the transfer of the rent amount to the beneficiary account, Hyracorp will return the payment to the source. It is advised that until a reimbursement ID is generated and delivered to the Users via email and SMS, they should not transfer the rent directly to the landlord.
Users understand and accept that, to the fullest extent allowed by law, they bear all risk related to their use of and access to the payment services. If Users allow or approve someone else to use their Hyracorp account in any way, Users will be held accountable for everything that person does. For any incidental, special, exemplary, or consequential damages, such as lost profits, data loss, or goodwill, service interruption, computer damage or system failure, or the cost of substitute goods or services, Hyracorp, any other party, or Processor involved in developing, producing, or delivering the payment Services shall not be liable.

XI. Content on the website

In an effort to make sure that the content on its website complies with applicable laws and this agreement, Hyracorp will make every effort to monitor such content. The following actions are prohibited by the Users, either through the Site or in other interactions with the Service, and they represent and warrant that they will not do so:
Attempt to gain unauthorized access to the Site or Hyracorp's related systems or networks, or assist others in attempting to do so (including, but not limited to, impersonating another User or using a false identity or address to gain access to the Site);
Use the Site to violate rights of intellectual property belonging to third parties, including, but not limited to, posting pirated music, computer programs, or links to such material on the Site or in the User's Profile;
Send spam or other repetitive or unsolicited messages in violation of applicable laws;
Transfer or store files, scripts, agents, or programs that contain software viruses, worms, Trojan horses, or other harmful computer code;
Tamper with or disrupt the integrity or functionality of the Service or the data contained therein;
License, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit the Service or any content contained in or made available through the Service in any way;
Alter or create derivative works based on Hyracorp's services or content; (ix) "frame" or "mirror" any content on any other server or wireless or internet-based device; or creating internet "links" to the Site
Reverse engineer or access the service with the intent to: (a) create a product that is competitive with the service; (b) create a product that incorporates concepts, features, functions, or graphics from the service; or (c) duplicate any concepts, features, functions, or graphics from the service.

XII. Information Created By Users

Users' and experts' opinions may be found in user-generated content ("UGC") on the Site, which Hyracorp does not pre-screen. Views expressed here do not necessarily reflect those of Hyracorp. None of the text, files, images, sounds, music, videos, or user-generated content (UGC) that users upload or post on the Site is claimed by Hyracorp as their own. Except for the restricted license outlined here, the Users retain any rights they may have in any UGC they submit on the Site. When deemed appropriate or necessary, Hyracorp will make every effort to monitor, edit, or remove such UGC.
By using any UGC in any way, the Users hereby specifically acknowledge and accept that Hyracorp will not be responsible for any losses or damages (direct or indirect) incurred by the Users as a result of such activities.

XIII. Intellectual Rights

Hyracorp encourages its users to respect others' intellectual property rights by doing the same. Users may not transmit or reproduce the intellectual property of others through the use of this site. The User shall be solely responsible for the ownership and right to use of any information submitted by Users via the Site.
For any infringement of Hyracorp's intellectual property rights, the User may be held accountable for the following actions, among others: (a) falsifying user content or information to seem as their own; (b) making use of the Content in any way, either openly or privately, to charge Users for brokerage; (c) utilizing the content in any way—directly or indirectly, in public or privately—to collect brokerage fees from third parties; and (d) using the content to exhibit behavior akin to a broker.
The User is fully responsible for any damages resulting from any infringement of Intellectual Property, and may not upload, post, or otherwise make available on the Site any Intellectual Property without the express permission of the owner in question.
Hyracorp retains the right, in compliance with Applicable Law, to bring the proper legal action against any User or third party for infringement of its intellectual property rights.
Furthermore, by using the Site, the User acknowledges and agrees that Hyracorp will own the intellectual property rights to all information and data that the User shares or provides.

XIV. Computer Virus Attacks/Operational Hazards

Hyracorp makes no guarantees of any kind regarding the absence of harmful elements or operational hazards from the Site or any other software it uses for internal purposes, including computer viruses, worms, trojans, and other similar components that could endanger the information Hyracorp has access to.
In accordance with industry best practices, Hyracorp will make every effort to maintain the Site safe from any potential bugs, viruses, or other technological issues.
Hyracorp disclaims all liability for any harm or damage resulting from poor performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, link failure, site crash, malfunctioning software or hardware, network unavailability, communications line failure, theft or destruction, or unauthorized access to, alteration of, or use of information, whether that information results entirely or partially from negligence or from any other cause.

XV. Rental Contract

Should the User decide to use Hyracorp's rental agreement services, both the User and the relevant property owner must supply any Personal Information that may be needed to successfully complete the rental agreement's registration.
With respect to this Agreement, the User and the relevant property owner agree to: (a) to release Hyracorp from liability for any disagreement that might ever occur between them; (b) to hold Hyracorp harmless from any loss or injury that the User or the owner of the relevant property may experience as a result of, stem from, or be connected to any dishonest, careless act or prohibited conduct by another User. Bear any registration or stamp duty costs associated with the rental agreements or any related agreements in accordance with applicable law, and not hold Hyracorp accountable for any penalties that may result from failing to pay the required amount; (c) not hold Hyracorp accountable for any losses they may sustain from disclosing information needed to register the rental agreement; and (d) provide Hyracorp or third parties with additional information as needed to finish the registration process.

Hyracorp makes no express or implied representations or warranties to the User with regard to the Services or otherwise regarding this Agreement, including the implied warranties of merchantability and fitness for a particular purpose. Prior to interacting with other Users, persons, or Third Party Service Providers on and through the Site, the User understands and acknowledges that the User assumes certain risks. The User shall be solely responsible for such User's personal assessment of specific requirements with regard to interaction with other Users, persons, or Third Party Service Providers.
Hyracorp hereby expressly disclaims any liability or responsibility of any kind arising from any Content posted on the Site or made available to Hyracorp by any User or third party, or from any service defect that results from a Third-Party Service Provider and affects the User.
Hyracorp disclaims all warranties regarding the Services, the outcomes of using them, the satisfaction of the User's needs or expectations, the availability of the Site, and the absence of technical errors.
The correctness or dependability of any third-party reports, market data, research, and analyses made accessible on the Site, as well as any external web links indicated on the Site, are not under Hyracorp's purview.
It is not required of Hyracorp to physically meet Users or to run background checks or police inquiries. Hyracorp's algorithm-based technological procedure, which forbids Brokers from accessing the Site and using the Services, is referred to as the "genuine verified owner" and "genuine verified tenants/buyers" on the Site. It is limited in scope and is done so with best efforts. Hyracorp does not take responsibility for the veracity of the Users' claims, and it takes User Information in good faith.
If a user engages in Prohibited Conduct and uses Third-Party Service Providers' services, Hyracorp will not be responsible for any losses, fees, charges, or damages.
Hyracorp disclaims all liability and responsibility for compensating, refunding, or reimbursing any User for any losses, damages, or costs incurred by the User as a result of the User's Account being suspended or deactivated.
Hyracorp disclaims all liability for any fees, charges, costs, or expenses incurred by users of the Site or Services from third parties. For any reason, Hyracorp shall not be held responsible for any disagreements or legal actions that may arise between the User and such third party; any such disputes or actions must be settled outside of the Site without mentioning or using Hyracorp.
Any cookies or other tracking technologies that Third Party Service Providers may employ on the Site are not governed by the Agreement, nor does Hyracorp have access to them. The User may, at any time, choose to opt out of personalized advertisements from these parties; nevertheless, to the extent that advertising technology is integrated into the Services, the User may continue to receive relevant updates and advertisements. When the User sees or utilizes these customized ads, Hyracorp disclaims all obligation and responsibility.
To the extent and for the duration of such period, Hyracorp shall not be liable for any non-performance, defective performance, or late performance of any Services or of its obligations under this Agreement if such non-performance, defective performance, or late performance is caused by acts of God, declared or undeclared war, civil unrest, insurrection, or rioting, acts (including inaction) of any Governmental Authority, fire, floods, strikes, lockouts, or industrial action.

XVIII. Indemnity

"The fees paid by the User for using the Services in relation to which such liability of Hyracorp arises shall be the limit of Hyracorp's total aggregate liability under this Agreement and in relation to anything which Hyracorp has done or not done in relation with this Agreement."

XVII. Restrictions From Liability

Against all claims, suits, legal proceedings, losses, costs, expenses, claims, lawsuits, and/or damages (including reasonable attorney fees) incurred and/or suffered by Hyracorp, whether directly or indirectly, resulting from an act or a failure to act on the part of any User, person, or Third-Party Service Provider for any reason whatsoever, and against any claims, suits, and/or legal proceedings brought by third parties, including but not limited to the User's: (a) breach of any of the provisions of this agreement; (b) claims made by third parties due to actual or purported intellectual property infringement;(c) any claims brought by governmental authorities as a result of the user's breach of applicable law; or (d) deliberate misconduct or actual or suspected gross negligence relating to the User's use of the Services or this Agreement. (e) A dishonest action taken by a user that causes harm or loss to themselves, other users, or outside parties.

XIX. Real Estate Regulatory Authority

The Users shall be presumed to be aware of the guidelines and policies pertaining to the Real Estate Regulatory Authority (RERA) of the relevant Indian state for the purposes of this Agreement and the Services connected thereto. Hyracorp advises Users to check the relevant RERA website from time to time for information and updates about any property that is featured on the Site before completing any transactions or deals.
Unless specifically noted otherwise, Hyracorp does not support or promote any property on the Site and will not be held responsible for listing any property on the Site that violates the state's RERA regulations.

XX. User Grievance

Any user claim regarding inconsistencies or improper use of information submitted to Hyracorp may be directed to the grievance officer, whose information is included below and who has been designated by Hyracorp for this reason.
The grievance officer shall address the grievance within one month of the date of receipt of such grievance from the User.

XXI. Revision

Without giving the User prior notice, Hyracorp may alter, update, or modify this Agreement in whole or in part; provided, however, that notice of such changes will be posted on the Site.
The User agrees to acknowledge and accept any updates, alterations, or changes to the Agreement by using the Services and the Site continuously.

XXII. Rules Of Government And Jurisdiction

This Agreement shall be interpreted and governed by Indian law, and the courts of Bengaluru will have exclusive jurisdiction over any action, claim, dispute, or difference arising out of or related to it, including any inquiry into its existence, validity, or termination (Dispute). In spite of the foregoing, Hyracorp is free to initiate legal actions in any courts or tribunal outside of Bengaluru that it, at its sole discretion, deems appropriate and expedient.
